3. Account Registration and Security

3.1. Account Creation

• Your phone number is your identity key
• One account per phone number
• You must provide accurate, current, and complete information
• You are responsible for maintaining account confidentiality

• Protect your phone: It's your primary authentication method
• Never share sign-in codes with anyone (we'll never ask for them)
• Notify us immediately of unauthorized access or security breaches
• You are liable for all activities under your account

3.3. Account Termination

We reserve the right to suspend or terminate accounts that:

• Engage in fraudulent or abusive behavior

• Are inactive for extended periods (notification provided)

4. Payments and Financial Terms

4.2. Premium Service Payments

• Service Issues: Partial/full refund based on circumstances
• Refund Timeline: 5-10 business days to original payment method
• Disputed Tasks: Resolved based on photo proof and agent documentation
• Digital Content: No refunds on AI answers or consumed digital services

5. Your Responsibilities and Conduct

5.1. Lawful Use

You agree to use Mero Sanjal only for lawful purposes. You may NOT:

• Violate any local, national, or international laws
• Request illegal tasks or services
• Use the platform to facilitate fraud, money laundering, or other crimes
• Impersonate others or misrepresent your identity
• Provide false information or documentation

5.2. Task Requests

When requesting care/concierge or gift services:

• You have the authority to act for the beneficiaries you name
• Provide accurate addresses and contact information
• Tasks must be legal and safe for agents to perform
• You are responsible for customs duties on restricted items
• Do not request tasks involving hazardous materials, weapons, or illegal substances

5.3. Community Guidelines

In forums, comments, and community features:

• Be respectful and civil to others
• Do not post hate speech, harassment, or abusive content
• No spam, advertising, or promotional content without permission
• Do not share others' personal information
• Respect intellectual property rights
• Report inappropriate content to moderators

5.4. Prohibited Activities

• Attempting to access accounts or data not your own
• Reverse engineering, decompiling, or hacking the platform
• Using bots, scrapers, or automated tools without permission
• Bypassing payment systems or platform fees
• Creating multiple accounts to abuse promotions
• Interfering with platform security or functionality

6. Agents and Service Delivery

6.1. Agent Verification

All care/concierge agents and service providers are:

• Independent Contractors: Not employees of Mero Sanjal
• Rated: Based on past performance and user reviews
• Monitored: For quality and compliance

6.2. Service Delivery

• Best Efforts: Agents make best efforts to complete tasks as requested
• Photo Proof: Visual confirmation provided for all completed tasks
• Communication: You can message agents through the platform
• Timeline: Estimated delivery times are not guaranteed (circumstances may delay)

6.3. Limitations of Liability

While we vet agents and require proof, we do NOT guarantee:

• Outcomes beyond an agent's reasonable control (government delays, natural disasters, etc.)
• Third-party service quality (e.g., government office efficiency)
• Exact timing for tasks dependent on external factors
• Success on tasks that depend on beneficiary cooperation

If a task cannot be completed due to circumstances beyond the agent's control, escrowed funds are refunded according to our refund policy.

7. Content and Intellectual Property

7.1. Our Content

All content on Mero Sanjal—text, graphics, logos, icons, images, software, data—is the property of Divya Soft Pvt. Ltd. or its licensors and protected by:

• Copyright laws (Nepal and international)
• Trademark laws
• Other intellectual property rights

You may NOT reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit our content without written permission.

7.2. Your Content

When you post content (forum posts, reviews, comments), you grant us:

• A worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content
• The right to use your content for platform improvement and promotion
• You retain ownership of your content
• You can delete your content anytime (except legal retention requirements)

You agree to indemnify and hold harmless Divya Soft Pvt. Ltd., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of third-party rights (intellectual property, privacy, etc.)
• Your content or conduct on the platform
• Tasks you request that cause harm or liability

11. Dispute Resolution

11.1. Governing Law

These Terms are governed by the laws of Nepal, without regard to conflict of law principles.

11.2. Jurisdiction

You agree that any disputes will be resolved in the courts of Kathmandu, Nepal. You consent to personal jurisdiction and venue in these courts.

11.3. Informal Resolution First

Before filing a legal claim, please contact us to resolve the issue informally. Most disputes can be resolved through good-faith negotiation.

11.4. Arbitration (Optional)

For disputes over NPR 50,000, parties may mutually agree to binding arbitration under Nepal Arbitration Act rules instead of court proceedings.

12. Changes to Terms of Service

We reserve the right to modify these Terms at any time. When we make material changes:

• We will display a prominent notice on the website
• Changes take effect 7 days after notification

Continued use of Mero Sanjal after changes constitutes acceptance of updated Terms.If you do not agree, you must stop using the service.

13. Termination

• You may delete your account anytime via account settings or contact us
• Outstanding orders must be completed or cancelled before deletion
• Some data may be retained for legal/accounting requirements (see Privacy Policy)

13.2. Termination by Us

We may suspend or terminate your account immediately without notice if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your account poses security risks
• Required by law or court order

13.3. Effect of Termination

• You lose access to your account and data
• Outstanding payments are settled according to refund policy
• Provisions that should survive (liability, indemnification) remain in effect

14. General Provisions

14.1. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Mero Sanjal regarding use of the platform.

14.2. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

14.3. Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

14.4. Assignment

You may not transfer your account or these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, government actions, strikes, etc.).
